条款与条件

 

感谢您参与全球十大博彩公司评级和电力ELRP住宅项目(“试点”). 2021年3月26日，加州公用事业委员会(“CPUC”)发布决定D.21-03-056 which approved the Emergency Load Reduction Program (“ELRP”) pilot. The CPUC subsequently issued D.21-12-015对ELRP进行修改，其中包括针对住宅客户的大规模计划. 后来CPUC发布了D.23-12-005 which made additional modifications to the pilot. 参与受试点参与条款及条件(“条款”)的法律约束。.

  2. 参与者的资格. 西班牙&E应自行决定参与者的资格，其中必须包括:
    1. Participant receives electric service on a residential rate.
    2. Participant has an active service agreement with 西班牙&E.
    3. Participant has an interval data meter. 
    4. Participant is not enrolled in any other 西班牙&E, Demand Response Provider (“DRP”), 社区 Choice Aggregator (“CCA”), or third-party supply-side DR program.
    5. 参与者不是选择不参与试点的CCA的电力客户.
  3. 试点报名期. 飞行员 shall continue until at least December 31, 2025, 除非扩展, 或参与者的登记提前终止(“试点登记期”)或资格变更导致参与者退出登记.
  4.  ELRP一.6. 住宅 Customers Events. ELRP一.6. 住宅客户事件将在前一天由CAISO Flex警报或CAISO EEA手表触发. 活动时间为5月1日至10月31日，活动时间为下午4点至9点.

  9. No Warranty; Disclaimer. 西班牙&E expressly disclaims all warranties of any kind relating to the Pilot, 是否表达, implied or statutory (including, 但不限于, any implied warranties for conditions or merchantability, fitness for a particular purpose, title, non-infringement or misappropriation of intellectual property rights). 
  10.  责任限制. 在适用法律允许的最大范围内，在任何情况下，西班牙&E be liable for any indirect, 偶然的, special or consequential damages, arising in connection with the Pilot. 如果参与者不满意试点项目、本条款中的任何条款，或相信可持续发展目标&E has breached these 条款 in any way, 参与者的唯一和排他性补救措施是停止参加试验.
  11.  Pilot Participation Termination. 
    1. 可持续发展目标终止&E. 西班牙&E has the sole discretion to terminate the Pilot, or Participant’s participation in the Pilot, 在任何时候 without cause by providing Participant written notice.

  12. 一般. 
    1. 全部协议. These 条款 are the entire agreement between 西班牙&E参与者关于飞行员的资格和参与要求. 
    2. 没有赋值. These 条款 may not be assigned by Participant without 西班牙&E’s prior written consent. 
    3. 可分割性和弃权. If any provision herein is invalid or unenforceable, the remaining provisions will remain in full force and effect. 
    4. 生存. 终止参与者在试点项目中的注册不会影响双方在本条款项下的义务和权利，这些义务和权利根据其含义和上下文在终止后仍然有效. 
    5.  CPUC管辖. 本条款应遵守适用于ELRP的所有法律法规要求(包括, 但不限于, 任何决定, orders or rules of the CPUC).
